1. Handmade, Made-to-Order and Personalized Products

Handmade and Personalized Jewelry

Elena Braccini Jewelry Srl products, including rings, necklaces, bracelets, rosaries, pendants, earrings, medals, and other jewelry, are handcrafted or hand-finished. As such, they may present slight differences, variations, or characteristics inherent to artisanal craftsmanship. These features make each creation unique and do not affect the consumer's statutory rights under applicable law.

Whenever a piece of jewelry is made, modified, adapted, or assembled according to the customer's specific request — for example by selecting the size, engraving, material, finish, color, gemstone, medal, saint, religious subject, combination of elements, or any other individual feature chosen at the time of purchase — the product shall be considered made to measure or clearly personalized pursuant to Article 59(1)(c) of the Italian Consumer Code (Legislative Decree No. 206/2005).

For such personalized products, the right of withdrawal is excluded by law. The customer is informed of this exclusion before completing the purchase and, by confirming the order, acknowledges that the jewelry will be made or adapted specifically according to the instructions provided and therefore cannot be returned simply because of a change of mind, except in the event of a lack of conformity covered by the statutory legal guarantee.

2. Right of Withdrawal for Non-Personalized Products

Withdrawal for Standard Products

For standard products that are neither made to measure nor personalized and are purchased through the e-commerce website, consumers have the right to withdraw from the contract within 14 days from the date on which they, or a third party designated by them other than the carrier, acquire physical possession of the goods.

To exercise the right of withdrawal, the consumer must communicate their decision through an explicit declaration sent to the contact details indicated in the Terms and Conditions of Sale.

The returned product must be unused, undamaged, complete with its original packaging, accessories, and any documentation received.

The direct cost of returning the goods shall be borne by the consumer unless otherwise expressly stated by Elena Braccini Jewelry Srl.

The right of withdrawal does not apply to products that are made to measure or clearly personalized.

3. International Shipping and Customs Procedures

Shipments Outside the European Union

Shipments to countries outside the European Union may be subject to customs inspections, checks by local authorities, requests for documentation, customs clearance delays, customs duties, import taxes, administrative fees, and other charges imposed in the destination country.

These circumstances are beyond the control of Elena Braccini Jewelry Srl and may affect the estimated delivery times communicated at the time of purchase.

The customer agrees to cooperate promptly with the courier, customs authorities, and, where necessary, Elena Braccini Jewelry Srl by providing any information or documentation required for customs clearance.

In the event of failure to cooperate, non-payment of customs charges, or refusal to accept the shipment, any storage, return, reshipping, or administrative costs incurred may be charged to the customer, to the extent permitted by applicable law.

The mandatory provisions of Article 63 of the Italian Consumer Code regarding the transfer of risk remain unaffected.

4. Customs Duties, Taxes and Import Charges

Costs Payable by the Customer for Shipments Outside the European Union

For shipments outside the European Union, the product prices and shipping costs displayed at checkout do not include any customs duties, import taxes, local VAT, administrative fees, customs clearance charges, or any other fees imposed by the authorities of the destination country or by the courier.

Where applicable, these charges shall be borne exclusively by the customer and must be paid according to the procedures required by the competent authorities or the courier.

As such charges vary depending on the destination country's regulations, the customs classification of the product, and the shipment value, customers are advised to contact their local customs authorities before placing an order.

Failure to pay customs duties, taxes, or import charges may result in delays, storage fees, non-delivery, or return of the shipment to the sender, with any related costs being charged to the customer, to the extent permitted by applicable law.

5. Delivery and Transfer of Risk

Product Delivery

Products will be delivered to the address provided by the customer at the time of purchase.

Pursuant to Article 63 of the Italian Consumer Code, when the customer is a consumer, the risk of loss of or damage to the goods passes to the consumer only when the consumer, or a third party designated by them other than the carrier, takes physical possession of the goods.

If the customer independently chooses a carrier other than those offered by Elena Braccini Jewelry Srl, the risk passes to the consumer when the goods are delivered to the carrier selected by the customer, in accordance with Article 63(2) of the Italian Consumer Code.

6. Legal Guarantee of Conformity

Statutory Legal Guarantee

Products sold to consumers are covered by the statutory legal guarantee of conformity provided for under Articles 128 et seq. of the Italian Consumer Code.

Elena Braccini Jewelry Srl shall be liable for any lack of conformity existing at the time of delivery and becoming apparent within the time limits established by law.

In the event of a lack of conformity, the consumer is entitled to the remedies provided by the Italian Consumer Code, including, where applicable, repair, replacement, price reduction, or termination of the contract.

Minor differences, irregularities, or variations resulting from the handmade nature of the jewelry shall not constitute defects of conformity, provided that they do not affect the product's functionality, safety, or essential conformity with its description.

I declare that I have read and accepted the Terms and Conditions of Sale.

I acknowledge that jewelry made according to my specific requests or otherwise personalized, including products modified or assembled according to the selected size, engraving, material, finish, color, gemstone, medal, saint, religious subject, combination of elements, or any other individual feature chosen at the time of purchase, constitutes made-to-measure or clearly personalized goods and is therefore excluded from the right of withdrawal pursuant to Article 59(1)(c) of the Italian Consumer Code.

I further acknowledge that, once the order for a personalized product has been confirmed, Elena Braccini Jewelry Srl may begin manufacturing the jewelry and that the product cannot be returned simply because of a change of mind, except in the event of a lack of conformity covered by the statutory legal guarantee.

For shipments outside the European Union, I also acknowledge that any customs duties, import taxes, administrative fees, customs clearance charges, or other fees required in the destination country are not included in the purchase price and shall remain my responsibility.
